In a deeply disturbing revelation, a lumber mill in Alabama has come under scrutiny for maintaining what has been described as the deadliest workplace in America, despite a harrowing record of safety violations. This facility, which has seen workers maimed, crushed, burned, and worse, tragically resulted in the deaths of three individuals, with one incident being so severe that minimal remains were recovered.
Horrific Conditions and Repeated Violations
Located in Alabama, Phenix Lumber Co. has been cited for over 180 safety violations, accumulating millions in fines. Shockingly, operations at this facility continued unabated, even as employees faced daily threats to their lives due to grossly inadequate safety measures. Reports indicate that workers were forced to interact with active machinery without necessary shutdowns for clearing jams, missing safety guards, and poorly maintained equipment that frequently malfunctioned.
OSHA's Involvement and Limitations
The U.S. Occupational Safety and Health Administration (OSHA) has repeatedly identified this mill as one of the "worst of the worst" employers in terms of safety violations. However, due to limitations under federal laws, OSHA was unable to shut down the facility permanently. Despite imposing significant fines, including a historic $1.9 million penalty in 2011 later reduced to $300,000 by a judge, the mill continued its operations with little to no real accountability for the continuous hazards.
Tragic Losses and Company Response
The fatalities and injuries at this mill paint a grim picture of neglect and disregard for worker safety, culminating in incidents like the gruesome death of a worker inside a wood-chip silo in 2020 and another in 2011, where a maintenance supervisor suffered a fatal accident so severe that recovery was described in the most heart-wrenching terms by first responders.
Call to Action
This situation has rightly sparked outrage and calls for a full federal investigation into the persistent operation of the mill despite its egregious safety record. There is a strong demand for the owners and executives, part of one of the wealthiest families in eastern Alabama, to be held personally accountable for fostering a culture of negligence.

Tampa Contractor Sentenced for Fraud and Safety Violations Leading to Worker's Death
In a significant legal development, a Tampa wood-framing construction contractor has been sentenced to four years in federal prison following a series of serious criminal and safety violations, including fraud and the tragic death of an employee due to neglect of safety standards. This case highlights the severe consequences of disregarding legal and safety regulations in the construction industry.
Background and Legal Proceedings
The contractor was involved in a wide-ranging criminal scheme that included failing to pay over $33.7 million in federal employment taxes and not providing adequate workers' compensation insurance coverage for his employees. By falsifying worker’s compensation insurance applications, the contractor significantly underreported the number of workers, leading to a substantial loss of over $22.7 million in premiums for several insurance companies.
Safety Violations and Fatal Incident
Moreover, between 2018 and 2022, the contractor consistently ignored the safety requirements set by the Occupational Safety and Health Administration (OSHA), particularly regarding fall protection for workers. Despite receiving multiple citations from OSHA in 2019 for failing to provide necessary fall protection, the contractor continued to neglect these crucial safety measures. Tragically, this ongoing disregard for safety resulted in a fatal incident in March 2020, where a worker fell from a roof in windy conditions and died from the injuries sustained due to the lack of fall-protection gear.
Sentencing and Restitution
As part of the sentencing, the contractor is required to forfeit more than $5.5 million in assets, including real properties and cash, to the United States and to pay over $55 million in restitution. This substantial financial penalty reflects the gravity of the offenses and the significant impact on the U.S. Treasury, insurance companies, and the victims of the fraudulent activities.

Acting U.S. Attorney emphasized the commitment of federal prosecutors to holding individuals accountable who jeopardize worker safety and engage in fraudulent activities. Serious Trench Collapse Incidents Lead to Substantial Fines for California Contractors
In a notable victory for workplace safety, the determined efforts of the U.S. Department of Labor have led to a significant development in a case involving a New York-based roofing company known for its disregard of fall protection measures. After facing vigorous litigation, the company has ceased contesting the severe citations and penalties imposed by OSHA, amounting to $687,536, for violations observed at a New Jersey site in 2022.
This resolution comes after an OSHA inspection in August 2022 at a residential construction site revealed multiple employees working on steep-slope roofs without the necessary fall protection. This inspection wasn't the first; it followed a tragic pattern of safety violations, including an incident less than six months prior where an employee suffered a fatal fall in Spring Valley, New York.
The citations issued encompassed three per-instance egregious willful fall protection violations, a willful unsafe ladder violation, and four serious violations. This decision to withdraw its contest notice, just one week before a scheduled trial, affirms the citations and their related penalties.
The implications of this case are far-reaching. Regional Solicitor emphasized the importance of holding employers accountable for repeatedly ignoring critical safety standards. OSHA Area Director reinforced this stance, highlighting the clear message sent to employers that deliberate disregard for worker safety will not be tolerated.
This case not only underscores the commitment of the Department of Labor's Office of the Solicitor and OSHA's investigative efforts but also serves as a reminder of the consequences of neglecting worker safety. It's a call to action for all employers to prioritize the well-being of their employees by adhering to essential safety regulations.

Recent trench collapse incidents across the United States have once again brought to light the critical risks associated with excavation work. In California, two plumbing contractors faced hefty fines totaling $530,000 after a trench collapse that seriously injured a worker, underscoring the dire need for strict adherence to safety protocols in trenching operations.
Incident Details and OSHA Citations
The incident occurred on February 10 in San Mateo during a residential sewer line project when a trench over 9 feet deep collapsed, partially burying a worker in his 30s. The worker was rescued approximately an hour later and hospitalized, fortunately surviving the ordeal. Following the incident, California's Occupational Safety and Health Administration (Cal/OSHA) cited the involved companies, Smelly Mel’s Plumbing and Sewer Rat Plumbing, for multiple safety violations related to the collapse.
Nature of Violations and Fines
Cal/OSHA issued eight violations to each company, with two being designated as "willful," indicating that the businesses were aware of the safety hazards but failed to take corrective action despite prior warnings. The total fines imposed amount to $529,640. The violations included:
Lack of adequate cave-in protection.
No safe means of exit from the trench.
Failure to inspect the trench before allowing workers to enter.
No protection from falling debris into the trench.
Inadequate foot protection, exposing workers to potential injuries from heavy equipment like jackhammers.
Absence of trained personnel to provide first aid.
Violation of Cal/OSHA permitting requirements for trenching.
Lack of regular toolbox safety meetings on the jobsite.
Cal/OSHA's Stance on Trench Safety
Cal/OSHA Chief emphasized the severe hazards of trench collapses in construction, stating, "Trench collapses remain one of the most serious hazards in construction, and employers must take all necessary steps to protect their employees." The citations and fines serve as a stark reminder to all businesses involved in excavation and construction to prioritize worker safety and rigorously implement all required safety measures.

These incidents across various states highlight the ongoing challenges and dangers of trench work. It is imperative for employers to not only comply with safety regulations but also actively ensure that these practices are effectively communicated and enforced on the ground.
